FAQ

For how long do drug companies have exclusive rights?

Apart from patent rights, companies can have exclusive rights for manufacture and distribution of new drugs. Patent is valid for 20 years from the date on which the application was filed in the United States. Drug exclusivity lasts for five years during which the company has exclusive rights to manufacture and distribute the new drug.

How long is Orphan Drug exclusivity?

The FDA can issue approval for orphan drugs which show promise in the treatment, prevention, or diagnosis of rare diseases or conditions that affect fewer than 200,000 people in the United States. Example: Zelboraf (vemurafenib) was designated as an orphan drug in 2014, and the designation expired in 2021, which means it is now an exclusive product for the originator, Roche.
